It might be, but first the US needs to pass a new and relevant VRA and ensure that redistricting simply can’t be done by political appointees. There simply has to be a non partisan body to ensure that elections are conducted on a level playing field. Secondly, a Democratic controlled Congress simply has to use its power to curtail the kind of matters that the USSC may adjudicate. They are clearly legislating from the Bench and using their power to rewrite legislation in ways that meet their political goals. It’s outrageous that nine, or rather, six judges are effectively making it up as they go along.
